TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (hereinafter “TCS”) govern the sales of products concluded on the website https://projectkroma.com (hereinafter the “Site”), published by KROMA IMPORT, a simplified joint-stock company (SASU) with a share capital of €500.00, headquartered at 17 RUE DE BAVILLIERS, 90000 BELFORT, France, registered with the Belfort Trade and Companies Register (RCS) under number 101 985 125, intra-community VAT number: FR24101985125.

By placing an order on the Site, the Client accepts these TCS fully and without reservation.

1. Products
The products offered for sale are described with the greatest possible accuracy. Photographs are not contractual. Product offers are valid within the limits of available stocks.

2. Prices
Prices are indicated in Euros (€) including all taxes (TTC).
The seller reserves the right to modify prices at any time. Products are invoiced based on the rates in effect at the time the order is validated.

3. Orders
Any order placed on the Site implies full and unreserved acceptance of these TCS.
The client receives a confirmation email summarizing their order. The seller reserves the right to refuse any order for a legitimate reason (e.g., abnormal order, bad faith, prior dispute).

4. Payment
Payment is made online by credit card or via secure providers (Stripe, PayPal, etc.).
Debiting is immediate. Transactions are secure, and banking data is never retained by the seller.

5. Delivery
Products are delivered to the address indicated by the Client during the order.

Deadlines and Terms:
Delivery is made within an indicative period of 3 to 5 business days from the shipment of the order (excluding weekends and public holidays).

Shipping Costs:

  • Pick-up Point Delivery: €3.90 (incl. tax).
  • Free Delivery: Offered for any order greater than or equal to €100 (incl. tax) (excluding shipping costs).

Delays and Liability:
The Seller makes every effort to respect the indicated delivery times. However, they cannot be held responsible for consequences due to a shipping delay not of their making (e.g., strikes, bad weather, force majeure).

Uncollected Parcels:
In the event of the parcel being returned to the Seller due to non-collection by the Client (pick-up point or post office) within the allotted time, the order will be refunded, minus the outbound shipping costs actually incurred.

6. Right of Withdrawal
In accordance with Article L221-18 of the Consumer Code, the Client has a period of 14 days from the receipt of their order to exercise their right of withdrawal, without having to justify a reason or pay penalties, with the exception of return costs.

30-Day Commercial Extension
In addition to this legal right, Project Kroma grants its Clients a total period of 30 days from receipt of their order to change their mind and return the products. The conditions and terms of return are detailed in our Refund and Returns Policy.

7. Returns & Refunds
Products must be returned in perfect condition, complete, unused, and in their original packaging if possible.
Return shipping costs are the Client’s responsibility except in the case of a defective product or error on our part.
Refunds are processed within 7 days after receipt and verification of the product.

8. Warranty
In accordance with legal provisions, all products benefit from the legal guarantee of conformity (Articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

9. Liability
The seller cannot be held liable for indirect or intangible damages related to the use or misuse of the products sold.

10. Personal Data
Personal data collected is processed in accordance with our Privacy Policy, in compliance with the General Data Protection Regulation (GDPR).

11. Intellectual Property
All elements of the Site (texts, visuals, images, logo, domain name) are protected by intellectual property law. Any unauthorized reproduction or use is prohibited.

12. Applicable Law – Disputes
These TCS are subject to French law.
In the event of a dispute, an amicable solution will be favored. Failing that, the French courts shall have exclusive jurisdiction.
